THE IMPACT AND ROLE OF DIFFERENCES IN THE RULES OF JURISPRUDENCE IN THE DISAGREEMENTS OF JURISTS"

Abstract

Differences in the principles of Istinbat the methodologies through which Islamic legal rulings are deduced have played a fundamental role in shaping the diversity of juristic opinions within Islamic jurisprudence.This study examines the nature of these methodological variations analyzing how differences in interpretive rules,evidentiary preferences and approaches to textual reasoning contribute to divergent fiqh rulings among classical and contemporary scholars.The research concludes that such differences rather than being a source of discord,reflect the richness,flexibility and depth of the Islamic legal tradition allowing it to address diverse contexts and evolving circumstances while remaining rooted in its primary sources.
