THE METHODOLOGY AND STYLE OF TAFSIR TAYSIR AL-QURAN IN REASONING ABOUT IJTIHADIST DISCUSSIONS RELATED TO THE JURISPRUDENCE OF MARRIAGES

Abstract

In Tayseer-ul-Quran, the verses of the jurisprudence of marriage are explained with simplicity, clarity and practical guidance. The focus of the discussions is on “family stability” and “rights and responsibilities”. The views of the four Imams, hadith scholars and ancient jurisprudential sources are given primary importance in the interpretation, but at the same time, the objectives of the Sharia (peace, non-harm, justice, family balance) are made the basis of ijtihad. Issues arising in modern times such as: the status of the guardian in marriage, the rights and powers of women, the legal aspects of divorce and khula, maintenance and domestic responsibilities, the Sharia status of oppression and coercion against women, the changing trends of marriage, etc. On all these topics, balanced, contemporary and jurisprudential guidance is presented in the light of the Quran. There is neither a tendency towards liberal interpretations nor unnecessary severity; rather, family rules are presented in conjunction with social expediency. After the literal explanation of the verses, the jurisprudential implications and then the practical social application are explained, which helps the reader understand the meaning of the verse, its original ruling, and its practical implications.
